The country has a great economic boom and more and more foreigners settled there for its sunshine, its quality of life and almost non-existent taxation.
There are several possibilities for a foreigner to purchase in Thailand:
- Buy an apartment in a condominium. Foreigners of all nationalities can buy an apartment in their own name and have the full ownership of the property for an unlimited period.
The condominium licenses in Samui are increasingly rare.
- Buy land or a house. The foreigners cannot buy land in their name and therefore have full ownership of the land. We must therefore incorporate a company associated with Thais. 1 foreign director for 2 Thai partners. You will be the only director of the company with full powers. Foreigners can own the property built on the land. Your lawyer will know very well help you build this company and full enjoyment of the land.
- Purchase your property with a lease agreement. The property is rented for a maximum period of 30 years, renewable in the terms defined in the contract.
Each of these contracts is recorded at the Land Office.
When you buy land, do not take into account only land with a title Chanote, Nor Sor 3 or Nor Sor 3 Gor. Only they can be purchased or hired and registered in the Land Office. These deeds are also required to obtain a building permit.
In this regard, since May 30, 2014, new regulations regarding construction were passed to preserve the landscape and better control constructions.
